Partner David Bigge discusses “The Surprising Relevance of Neer at 100” in Kluwer Arbitration article

Kluwer Arbitration has posted a short piece by Wordstone partner David Bigge, “The Surprising Relevance of Neer at 100”.

In the piece, David explores how the U.S.-Mexico General Claims Commission reached its decision in Neer, which established the minimum standard of treatment under customary international law, 100 years ago this month.

David argues that while the minimum standard articulated in Neer was qualified or rejected by subsequent arbitral tribunals, Neer remains relevant as a model for arbitral restraint in the face of uncertain legal standards, State sovereignty, and the right to regulate.
